I have tried without much success to take an interest in the parboiled debate over Judge Russell Fagg’s so-called shadow campaign for the U.S. Senate. The American Democracy Legal Fund has filed a federal complaint against Yellowstone County District Judge Russell Fagg, alleging that he violated federal campaign finance laws by campaigning for the U.S. Senate without filing for the seat. The complaint, filed with the Federal Election Commission, contends that while Fagg has not yet filed for office or resigned his seat from the bench, he has actively distributed campaign literature and launched a campaign website with a donation platform. When a ballot initiative’s chief talking point is wrong in two different ways, it’s time to give it a closer look. Such were my thoughts when I started hearing radio ads for Constitutional Initiative 116, the so-called Marsy’s Law amendment to the Montana Constitution. The ads say it’s time to guarantee “equal rights for victims.”

Next month, less than a year after he was censured by the Montana Supreme Court for comments he made while sentencing a man who raped a 14-year-old girl, retired District Judge G. Todd Baugh will receive a lifetime achievement award from the Yellowstone Area Bar Association. Marian Bradley, president of the Montana chapter of the National Organization for Women, said there is “something absolutely wrong” with members of the local bar giving Baugh the award.
