{"id":19257,"date":"2017-09-04T14:35:32","date_gmt":"2017-09-04T20:35:32","guid":{"rendered":"http:\/\/lastbestnews.com\/site\/?p=19257"},"modified":"2017-09-04T14:36:15","modified_gmt":"2017-09-04T20:36:15","slug":"lawsuit-says-license-suspensions-pick-on-the-poor","status":"publish","type":"post","link":"https:\/\/montana-mint.com\/lastbestnews\/2017\/09\/lawsuit-says-license-suspensions-pick-on-the-poor\/","title":{"rendered":"Lawsuit says license suspensions pick on the poor"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"addboard alignleft wp-image-19258 size-full\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/mt-license.png\" alt=\"\" width=\"336\" height=\"231\" \/><\/a>A national civil rights group based in Washington, D.C., has filed a class-action lawsuit against the state of Montana for suspending the licenses of people who have safe driving records but are otherwise too poor to pay their traffic tickets or court costs.<!--more--><\/p>\n<p>Equal Justice Under Law\u00a0<a href=\"https:\/\/www.missoulacurrent.com\/wp-content\/uploads\/2017\/09\/1-Montana-Complaint.pdf\" target=\"_blank\" rel=\"noopener\">filed its suit<\/a>\u00a0in Butte District Court on Friday, saying that the state\u2019s wealth-based driver\u2019s license suspension scheme traps the poorest residents in a cycle of poverty.<\/p>\n<p>The lawsuit names Gov. Steve Bullock and Attorney General Tim Fox as defendants, as well as Sarah Garcia, head of the state Motor Vehicle Division. The governor\u2019s office couldn\u2019t be reached for comment\u00a0Friday.<\/p>\n<p>\u201cThe Motor Vehicle Division automatically and indefinitely suspends the driver\u2019s licenses of people who owe court-ordered fines, costs and restitution, even if they simply cannot afford to pay,\u201d the suit contends. \u201cWithout a driver\u2019s license, people already facing the harsh realities of owing court debt while living in poverty face additional hurdles of being unable to drive to and from work, get their children to daycare, keep medical appointments, and care for their family members.\u201d<a href=\"https:\/\/www.missoulacurrent.com\/linkout\/17158\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" title=\"Sushi Hana Banner 728x90\" src=\"https:\/\/www.missoulacurrent.com\/wp-content\/uploads\/2017\/07\/Sushi-Hana-Banner-728x90.jpg\" sizes=\"auto, (max-width: 728px) 100vw, 728px\" srcset=\"\/wp-content\/uploads\/2017\/07\/Sushi-Hana-Banner-728x90.jpg 728w, \/wp-content\/uploads\/2017\/07\/Sushi-Hana-Banner-728x90-350x43.jpg 350w, \/wp-content\/uploads\/2017\/07\/Sushi-Hana-Banner-728x90-700x87.jpg 700w\" alt=\"\" width=\"728\" height=\"90\" \/><\/a><\/p>\n<p>Equal Justice Under Law is focusing on Michael DiFrancesco, a 22-year-old Montana resident, to make its case. DiFrancesco was fined $185 for a civil infraction he committed when he was 14 years old and ordered to pay for and complete a substance abuse course.<\/p>\n<p><span class=\"m_-959722958402204720s2\"><div class=\"well\"><div class=\"dfad dfad_pos_1 dfad_first\" id=\"_ad_652\"><a target=\"_blank\" href=\"https:\/\/goo.gl\/mjhWkW\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/201703_capeair_variable.jpg\" alt=\"CapreAir_Variable\" width=\"510\" height=\"180\" class=\"alignnone size-full wp-image-18069\" \/><\/a><\/div><\/div><\/span>At the time, the suit contends, he could not afford to pay the fine or the fee for the course. He received notice in 2009 that his driver\u2019s license had been suspended as a result. To get it back, he would have to pay all his court debts, plus an additional $100.<\/p>\n<p>DiFrancesco works in the construction field but has since lost his job because he lacks a valid license, according to the suit. It says he also has become homeless and has been convicted of driving without a license five times in the past three years, further driving up his debt to the court to the tune of $4,000.<\/p>\n<p>\u201cEspecially in a state like Montana with few public transportation options, losing a license is devastating,\u201d said Phil Telfeyan, the lead attorney and executive director of Equal Justice Under Law.<\/p>\n<p>\u201cUnable to drive, people often lose their jobs or have a hard time finding employment, making it even more unlikely that they will be able to pay their debts to the state. This system traps people who are poor in an impossible cycle of poverty, and it needs to end.\u201d<\/p>\n<p>According to the group, Montana suspends the licenses of roughly 10,000 drivers every year because they cannot pay court debts.
