Preston Brooks savagely beat Sen. Charles Sumner, of Massachusetts, in the Senate chamber. There was no Rule 19 then. Three days earlier, Sumner had referred to another senator as a &#8220;noise-some, squat, and nameless animal.&#8221; So the rule is a good idea, even if it was wielded clumsily by Sen. Steve Daines.<\/p><\/div>\n<p>I know my colleague David Crisp <a href=\"http:\/\/lastbestnews.com\/site\/2017\/02\/daines-shows-weakness-in-warren-debacle\/\">has already written<\/a> about Sen. Steve Daines\u2019 role in silencing Sen. Elizabeth Warren on the floor of the Senate, but David\u2019s piece was published on Wednesday.<\/p>\n<p>That same day, state Rep. Jeff Essmann of Billings, chairman of the Montana Republican Party, also wrote about the Daines-Warren incident in <a href=\"http:\/\/billingsgazette.com\/news\/opinion\/guest\/guest-opinion-daines-right-to-gavel-down-warren\/article_9cc1c259-07f6-52d0-8282-78f2cd9b91ac.html\">an op-ed for the Billings Gazette<\/a>. Essmann\u2019s piece was so crowded with misstatements and misleading information that it demands a response.<!--more--><\/p>\n<div id=\"attachment_16280\"  class=\"wp-caption module image alignleft\" style=\"max-width: 140px;\"><img loading=\"lazy\" decoding=\"async\" class=\"addboard wp-image-16280 size-full\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/1Kemmick.mug-copy-35.jpg\" alt=\"Ed\" width=\"140\" height=\"182\" \/><\/a><p class=\"wp-caption-text\">Ed Kemmick<\/p><\/div>\n<p>The jumping-off point for Essmann\u2019s guest editorial was <a href=\"http:\/\/billingsgazette.com\/news\/opinion\/editorial\/from-the-editor\/from-the-editor-steve-gavel-this\/article_7face57e-47a1-59a4-af55-dd607884e5eb.html\">a column by Gazette editor Darrell Ehrlick<\/a>, published on Feb. 9, in which Ehrlick characterized Daines\u2019 actions as \u201cshameful\u201d and \u201cun-American,\u201d among other things.<\/p>\n<p>But Essmann did not write to accuse Ehrlick of hyperbole. Instead, he spent half of his op-ed making the bizarre claim that Daines was right in silencing Warren because \u201cpartisan gridlock\u201d is ruining the country.<\/p>\n<p>\u201cThe real issue here,\u201d Essmann wrote, \u201cis whether Washington begins to work for the American people or remains stuck in partisan gridlock. In November, the American people spoke out loud and clear for a new direction in Washington, one where their government works for the people and not the other way around. Montanans and millions of other Americans chose Donald Trump to be the next president of the United States.\u201d<\/p>\n<p>There\u2019s a lot to unpack there, but let\u2019s try.<\/p>\n<p>First, if the \u201creal issue\u201d is partisan gridlock, why invoke <a href=\"http:\/\/www.rules.senate.gov\/public\/index.cfm?p=RuleXIX\">Senate Rule 19<\/a>, barring senators, on the floor of the Senate, from imputing to another senator \u201cany conduct or motive unworthy or unbecoming a Senator&#8221;?<\/p>\n<p>If the Democrats really were engaging in delaying tactics during the confirmation process and there was no procedural way to fight those tactics, why is it honorable to invoke an entirely separate, rarely used rule to get the job done?<\/p>\n<p>Any reasonable interpretation of Rule 19 is that it was intended to keep floor debates civil and peaceful. But the occasion was not a debate between senators. The occasion was consideration of having Sen. Jeff Sessions leave the Senate to join Trump\u2019s cabinet as attorney general.<\/p>\n<p>Ehrlick was surely right when he wrote that Warren should have been \u201cgiven the broadest latitude for speaking freely because no stones should be left unturned when it comes to having as much power as is given an attorney general.\u201d<\/p>\n<p>Next is Essmann\u2019s statement that the American people, in the recent election, \u201cspoke out loud and clear for a new direction in Washington.\u201d Considering that Hillary Clinton won 48 percent of the popular vote to Donald Trump\u2019s 45.9 percent, I would argue that Trump\u2019s mandate was rather muted and muddy.<\/p>\n<p>Then there is Essmann\u2019s contention that American voters want a government that \u201cworks for the people and not the other way around.\u201d But one reason this confirmation process has dragged on is that so many of Trump\u2019s nominees are billionaires with financial entanglements that reach into every corner of society.<\/p>\n<p><div class=\"well\"><div class=\"dfad dfad_pos_1 dfad_first\" id=\"_ad_652\"><a target=\"_blank\" href=\"https:\/\/goo.gl\/mjhWkW\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/201703_capeair_variable.jpg\" alt=\"CapreAir_Variable\" width=\"510\" height=\"180\" class=\"alignnone size-full wp-image-18069\" \/><\/a><\/div><\/div>If there was ever a time for careful deliberation and close scrutiny of Cabinet nominees, this is the year. We do need to make sure that Trump\u2019s people intend to work for us and not their own business interests. That should not be a partisan issue.<\/p>\n<p>I also found it interesting that Rule 19 specifically deals with imputing unworthy motives to a senator. Essmann is not bound by that rule, but to say, as he did, that Warren was \u201ctrashing the integrity of another senator to promote herself, her book and her political ambitions,\u201d is to trash her integrity and to make claims that he cannot begin to prove.<\/p>\n<p>A bit later he says that the Senate is governed by rules. \u201cRules that keep the U.S. Senate from becoming a middle-school playground where name calling is the norm.\u201d<\/p>\n<p>That argument would carry some weight if Essmann\u2014or Daines or Senate Majority Leader Mitch McConnell\u2014had been a fraction as critical of Donald Trump\u2019s vile, juvenile outbursts as they were of Warren.<\/p>\n<p>Two days before Daines silenced Warren, Trump, speaking to a gathering of sheriffs in Texas, was told of a Texas state lawmaker who was opposed to seizing the assets of drug dealers until they had been convicted\u2014a fairly conservative, constitutional stance.<\/p>\n<p><a href=\"https:\/\/www.washingtonpost.com\/video\/politics\/well-destroy-his-career-trump-jokes-at-meeting-with-county-sheriffs\/2017\/02\/07\/64e8e67e-ed59-11e6-a100-fdaaf400369a_video.html\">Trump\u2019s response<\/a>? \u201cWho is the state senator? Do you want to give his name? We\u2019ll destroy his career.\u201d<\/p>\n<p>Trump the tweeter has shattered every rule of decency during his short time in office, but this threat to destroy the career of a principled state legislator was shocking even from Trump.<\/p>\n<p>Did Essmann have anything to say about that? Not that I know of, but in the last paragraph of his op-ed he wrote: \u201cWe need leadership in Washington. \u2026 Montanans and Americans voted for that leadership in November.\u201d<\/p>\n<p>If the middle-schooler-in-chief is the kind of leader people wanted, and, seeing him in action, continue to want, a little indecorum on the floor of the Senate would seem to be the least of our worries.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I know my colleague David Crisp has already written about Sen.
