Keith Regier, R-Kalispell, introduced a bill banning Sharia law to uphold the \u201cfundamental rights guaranteed by our constitution.\u201d<!--more--><\/p>\n<p>The bill passed the Senate on a 28-21 vote, with four Republicans joining all 17 Democrats in opposition.<\/p>\n<p>On Friday, the Council on American-Islamic Relations urged legislators in Montana, Arkansas and Idaho to oppose such measures, calling them unconstitutional and an attack on the Islamic faith.<\/p>\n<p>If adopted, the legislation would prohibit state courts from considering so-called \u201cforeign laws,\u201d including Sharia law and Catholic Canon, so long as they\u2019re deemed to be in conflict with state or federal laws.<\/p>\n<p>\u201cLegislation clearly designed to stigmatize a particular faith is a violation of the U.S. Constitution\u2019s Establishment Clause, which prohibits government interference in religious affairs,\u201d Robert McCaw, the council\u2019s director of government affairs, said\u00a0on Tuesday. \u201cThe promotion and adoption of these unconstitutional bills sends a message that Islam is an officially disfavored religion.\u201d<\/p>\n<p>While Regier sees his bill as a means of safeguarding Americans\u2019 constitutional rights, opponents see it as a non-issue and an affront to those of Islamic faith.<\/p>\n<p><div class=\"well\"><div class=\"dfad dfad_pos_1 dfad_first\" id=\"_ad_652\"><a target=\"_blank\" href=\"https:\/\/goo.gl\/mjhWkW\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/201703_capeair_variable.jpg\" alt=\"CapreAir_Variable\" width=\"510\" height=\"180\" class=\"alignnone size-full wp-image-18069\" \/><\/a><\/div><\/div>McCaw said the bill is similar to the Oklahoma anti-Sharia constitutional amendment, which was struck down in federal court as a violation of the Establishment Clause.<\/p>\n<p>\u201cThis Montana bill would also be in clear violation of the First Amendment\u2019s command that government remain neutral in matters of religion,\u201d said McCaw. \u201cShould this legislation become law, I expect that it would meet the same fate as any other adopted bill that is not in line with our Constitution in protecting the religious freedoms of all citizens equally.\u201d<\/p>\n<p>Rachel Carroll Rivas, co-director of the Montana Human Rights Organization, said the legislation addresses a non-issue and is rooted in Islamophobia.<\/p>\n<p>The bill has not been scheduled for\u00a0a hearing date in the House, but\u00a0if it reaches that point, Caroll Rivas said, it\u2019s likely to face stiff opposition.<\/p>\n<p>\u201cThis doesn\u2019t necessarily rise to a level of concern for most legislators in the House,\u201d she said. \u201cIt\u2019s not a priority issue, but if it does end up in committee, there will be a robust conversation to be had, and there\u2019s going to be some new voices in opposition.\u201d<\/p>\n<p>Similar legislation has been introduced in Arkansas and Idaho, where Rep.
