HELENA \u2014\u00a0Montana farmers may soon face fewer regulations when it comes to diversifying their farm\u2019s income if three bills in the Montana Legislature find enough support.<\/p>\n

One bill, House Bill 325<\/a> would legalize the direct sale of raw milk. Another, House Bill 352<\/a>, would allow farmers to sell food from their own kitchens and a third bill would give them less liability when their farmland is used for tourism purposes.<\/p>\n

\u201cThe farm economy has been up and down,\u201d said Rep. Ross Fitzgerald, R-Fairfield. \u201cWe need to put another spoke on the revenue wheel.\u201d<\/p>\n

Fitzgerald is carrying House Bill 342<\/a>, which passed on second reading 79-21 last week. The bill would add \u201cagritourism\u201d to a list of activities in which guests are liable for their risk. Agritourism encompasses a wide variety of recreation, including everything from corn mazes to pumpkin patches.<\/p>\n

\u201cI would like to remind you that again there\u2019s such a thing called personal responsibility, and that has a major part in this,\u201d Fitzgerald said.<\/p>\n

But some lawmakers have reservations about just where personal responsibility begins and ends. Rep. Nate McConnell, D-Missoula, argued that because agritourism encompasses so many different activities, it would be difficult to determine what reasonable risk looks like in each case. He said this would make the likelihood of lawsuits increase significantly.<\/p>\n

\u201cIt\u2019s going to increase your insurance rates,\u201d McConnell said. \u201cWhat\u2019s that going to do? It\u2019s going to make it harder for the farmer or the landowner to get insurance.\u201d<\/p>\n

Other bills proved similarly contentious.<\/p>\n

Rep. Nancy Ballance, R-Hamilton, introduced House Bill 325<\/a> last week. The bill would allow farmers and ranchers to sell unpasteurized, or \u201craw\u201d milk, exclusively from their farms and directly to consumers, and would allow for herds of up to 10 cows and 20 sheep or goats for production.<\/p>\n

\u201cThis is the ultimate freedom bill,\u201d Ballance said. \u201cWhat could be more natural and more healthy?\u201d<\/p>\n

\"CapreAir_Variable\"<\/a><\/div><\/div>HB 325 also requires raw milk producers to label their products indicating the product has not been inspected by the state, and that it is for personal use only.<\/p>\n

Ballance said the inspiration for the bill partly came from seeing her mother overcook vegetables as a child, eliminating much of their nutritional value.<\/p>\n

\u201cWhen you apply that to milk it\u2019s exactly the same issue,\u201d Ballance said.<\/p>\n

During the bill\u2019s first reading last week, the committee room was filled to capacity with both supporters and opponents. The bill attracted so many supporters that there wasn\u2019t enough time for many of them to testify. More than a dozen people also came prepared to testify against HB 325, largely because of what they say are health risks.<\/p>\n

\u201cIt does not provide adequate disease, drug or antibiotic testing,\u201d said Krista Lee Evans, representing the Montana Milk Producers Association.<\/p>\n

Evans\u2019 concerns stem from the lack of clarity in\u00a0the bill regarding who performs those tests, as well as the fact that results would be self-reported. She said that creates a self-regulating industry.<\/p>\n

\u201cThe tests are collected by the permittee, the lab is selected by the permittee, and most importantly there\u2019s no reporting requirement,\u201d Evans said. \u201cThere\u2019s no way to know.\u201d<\/p>\n

Jeanne Rankin, a veterinarian based in Judith Basin County, also expressed concern about the spread of brucellosis due to many cows coexisting with elk, a risk of which she says is mitigated by the pasteurization process.<\/p>\n

Ballance, however, said there are plenty of other foods that carry similar risks, and the pushback from health organizations is because \u201cit just makes their life easier not to have to worry about it.\u201d<\/p>\n

Echoing Fitzgerald\u2019s comments about agritourism, Ballance\u00a0said the issue comes down to personal responsibility.<\/p>\n

\u201cYour responsibility as a buyer is to know who you\u2019re buying from,” Ballance said. “Look at the farm, see if it\u2019s clean, see if the conditions are right \u2026 and know the person you\u2019re buying from. It\u2019s a totally different buying experience than you would have if you were in the store.\u201d<\/p>\n

Rep. Greg Hertz, R-Polson, wants to see farmers be able to sell more than just raw milk. House Bill 352<\/a> is Hertz\u2019s attempt to allow farmers to sell any food product from their homes.<\/p>\n

\u201cWe\u2019ve always bought and sold product, bartered with our neighbors,\u201d Hertz said. \u201cThe local sanitarians primarily seem to think that the kitchen in my house isn\u2019t as clean, or doesn\u2019t have the proper equipment that the restaurant down the street does.\u201d<\/p>\n

Hertz\u2019s bill, called the Food Choice Act, would allow for the sale of homemade food products for home consumption. Producers of these products would not be susceptible to the regulations that traditional retailers or cottage food producers are.<\/p>\n

The Food Choice Act would be \u00a0an expansion of the deregulations put in place by last session\u2019s cottage food laws changes<\/a>. That law allows producers of low risk items like jam or baked goods<\/a> to sell food they produced in their kitchens.\u00a0HB 352 would allow for the sale of any food product.<\/p>\n

Levi Ostberg and Eric Bergman of the Montana Farmers Union said the Food Choice Act may be contradictory to federal livestock regulations, and have specific concerns with the sale of meat under the law.<\/p>\n

\u201cOur current meat processing inspection laws are good,\u201d Bergman said.<\/p>\n

That bill is slated for debate on Tuesday.<\/p>\n
