{"id":15697,"date":"2017-01-13T08:56:51","date_gmt":"2017-01-13T15:56:51","guid":{"rendered":"http:\/\/lastbestnews.com\/site\/?p=15697"},"modified":"2017-01-14T09:01:48","modified_gmt":"2017-01-14T16:01:48","slug":"opinion-the-irony-of-the-real-id","status":"publish","type":"post","link":"https:\/\/montana-mint.com\/lastbestnews\/2017\/01\/opinion-the-irony-of-the-real-id\/","title":{"rendered":"The irony of the Real ID"},"content":{"rendered":"<p>Like the footfalls of a villain in a thriller movie, Montana\u2019s Real ID imbroglio comes ever closer \u2026 and ever more ominous.<\/p>\n<p>Another footfall, closer and more ominous than the earlier ones, was heard on Jan. 5 when Washington declared that \u201cMontana is not in compliance with the Real ID Act and Federal agencies will not accept driver&#8217;s licenses\u201d issued by Helena.<!--more--><\/p>\n<p>Observers are familiar with the earlier footsteps; Montanans are familiar with the Real ID quarrel.<\/p>\n<p>In 2005, in the wake of 9\/11, Washington acknowledged that state-issued driver\u2019s licenses\u2014the default form of identification in the United States\u2014were often fraudulently obtained. As the authors of the Real ID Act noted, \u201cmost states did not \u2026 verify the true identity of the person before issuing the most universally accepted form of identification in the United States, the driver\u2019s license.\u201d Put bluntly, America\u2019s default ID was often not an ID at all.<\/p>\n<p>It fell to the Department of Homeland Security to establish \u201cminimum security standards for state-issued driver\u2019s licenses.\u201d (Minimum is not minimalist, but a digestible description of the standards is <a href=\"https:\/\/en.wikipedia.org\/wiki\/REAL_ID_Act\">available on Wikipedia<\/a>.) The bottom line: \u201cFederal agencies [are prohibited] from accepting for official purposes licenses and identification cards from states that do not meet these standards.\u201d<\/p>\n<div id=\"attachment_15699\"  class=\"wp-caption module image alignleft\" style=\"max-width: 144px;\"><img loading=\"lazy\" decoding=\"async\" class=\"addboard wp-image-15699 size-full\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/Bruce-Lohoff-4.jpg\" alt=\"BL\" width=\"144\" height=\"180\" \/><\/a><p class=\"wp-caption-text\">Bruce Lohof<\/p><\/div>\n<p>Montana\u2019s response, though not swift, was strong: In 2007 the 60th\u00a0Legislature made Real ID implementation illegal, saying that it was \u201cinimical to the security and well-being of the people of Montana, will cause unneeded expense and inconvenience to those people, and was adopted by the U.S. Congress in violation of the principles of federalism contained in the \u2026 U.S. Constitution.\u201d<\/p>\n<p>Then-Gov. Brian Schweitzer, who signed the legislation, doubled down on the inimical-to-security fear, telling Washington that \u201cMontana objects to the implementation of Real ID for a number of reasons, the most important of those being its threat to our privacy rights. &#8230; Montana will not agree to share its citizens\u2019 personal\u00a0and private information through a national database.\u201d<\/p>\n<p>Other footfalls came quickly. They\u2019ll culminate on Jan. 22, 2018, when Transportation Security Administration officers will begin to inform you that your Montana driver\u2019s license is an invalid form of ID and that \u201cyou will need an alternative identification to fly in the U.S.\u201d<\/p>\n<p>The quarrel raises more questions than answers. For instance, Montanans all over the spectrum, including the American Civil Liberties Union and the Alt-Right wingnuts, are opposed to the Real ID act. Why is that? For instance, folks who\u2019ve already shared, via social media, everything from their religious beliefs to their shoe size, fear the creation of a \u201cnational database.\u201d Why is that?<\/p>\n<p>In most industrial democracies, and in many developing nations, citizens routinely carry evidence of their bona fides in their pockets or purses. What they carry is <em>real<\/em>ly an ID. \u2026 in America, not so much. Why is that?<\/p>\n<p>But the irony of the quarrel is that folks who resist the creation of a Real ID often support agendas that cannot be pursued without one.<\/p>\n<p>For instance, law enforcement officers in Maricopa County, Arizona, have profiled Phoenix drivers who look Latino, requiring them to prove that they are not\u2014in the term of art\u2014\u201cundocumented immigrants.\u201d By definition, an \u201cundocumented immigrant\u201d has no documents to offer. But then, absent a Real ID, neither does anyone else.<\/p>\n<p><div class=\"well\"><div class=\"dfad dfad_pos_1 dfad_first\" id=\"_ad_652\"><a target=\"_blank\" href=\"https:\/\/goo.gl\/mjhWkW\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/201703_capeair_variable.jpg\" alt=\"CapreAir_Variable\" width=\"510\" height=\"180\" class=\"alignnone size-full wp-image-18069\" \/><\/a><\/div><\/div>Or for instance, President-Elect Donald Trump and many of his supporters in Montana have advocated the establishment of a \u201cMuslim Registry,\u201d until\u2014as Trump famously said\u2014\u201cour country\u2019s representatives can figure out what is going on.\u201d But a \u201cMuslim Registry\u201d requires an \u201ceverybody registry.\u201d How else can it be known that a Muslim living in, say, Billings, Mont., simply didn\u2019t register?<\/p>\n<p>Imagine the confrontation.<\/p>\n<p>Policeman: \u201cMr. Mohammed, show me your registration card.\u201d<\/p>\n<p>Mohammed: \u201cI don\u2019t need a registration card. I\u2019m a Christian.\u201d<\/p>\n<p>End of confrontation.<\/p>\n<p>The irony of the quarrel, too, is that folks resisting the creation of a Real ID data base fail to understand that it\u2019s a dream come true. Imagine\u2014living as they do in an us-versus-them world\u2014the comfort of knowing that everyone is registered by DHS specs.: \u201c(1) The person\u2019s full legal name, date of birth, and gender; (2) The person\u2019s driver\u2019s license or identification card number; (3) A digital photograph of the person; (4) The person\u2019s address of principal residence; (5) The person\u2019s signature.\u201d<\/p>\n<p>I\u2019m John Doe. You\u2019re not.<\/p>\n<p>I was born on &#8211;\/&#8211;\/&#8212;-, I\u2019m male, my number 123-456-789. You\u2019re different.<\/p>\n<p>I live at 123 Fourth St., Billings, Mont. You don\u2019t.<\/p>\n<p>Whoops. We still don\u2019t know whether you\u2019re black or Jewish or Latino or Muslim. It\u2019s still unconstitutional to ask.<\/p>\n<p><em>Bruce A.
