{"id":10879,"date":"2016-03-07T21:40:34","date_gmt":"2016-03-08T04:40:34","guid":{"rendered":"http:\/\/lastbestnews.com\/site\/?p=10879"},"modified":"2016-03-07T21:41:03","modified_gmt":"2016-03-08T04:41:03","slug":"hearing-previews-upcoming-political-corruption-trial","status":"publish","type":"post","link":"https:\/\/montana-mint.com\/lastbestnews\/2016\/03\/hearing-previews-upcoming-political-corruption-trial\/","title":{"rendered":"Hearing previews upcoming political corruption trial"},"content":{"rendered":"<p>District Judge Ray Dayton on Monday heard more than three hours of testimony in his Anaconda courtroom as he considers competing pre-trial arguments in a high-profile political corruption lawsuit.<!--more--><\/p>\n<div id=\"attachment_10880\"  class=\"wp-caption module image alignleft\" style=\"max-width: 140px;\"><img loading=\"lazy\" decoding=\"async\" class=\"addboard wp-image-10880 size-full\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/Art-Wittich-copy.jpg\" alt=\"Wittich\" width=\"140\" height=\"203\" \/><\/a><p class=\"wp-caption-text\">Art Wittich<\/p><\/div>\n<p>Commissioner of Political Practices Jonathan Motl is suing Republican state Rep. Art Wittich, alleging Wittich illegally coordinated with third-party nonprofit political groups during his 2010 campaign for the Montana Senate. The case pits the state\u2019s top political cop, an appointee of Democratic Gov. Steve Bullock, against one of the legislature\u2019s most staunchly conservative lawmakers.<\/p>\n<p>Dayton, who assumed jurisdiction of the long-running lawsuit last month, will take the testimony and arguments heard Monday into consideration and issue rulings this week.<\/p>\n<p>Most of what Dayton heard Monday had already presented to the court in legal briefs.<\/p>\n<p>On Monday he listened to testimony centered on the sworn statement of a former COPP employee who alleged that someone deleted emails from her state-run email account that could be germane to the lawsuit.<\/p>\n<p>Julie Steab, a former investigator who worked at the commissioner\u2019s office from January 2011 until she quit in October 2013, claimed there should have been emails in her state email account that illustrated Motl\u2019s political bias against Wittich.<\/p>\n<p>Steab also claimed that Motl, shortly after taking his post in June 2013, had expressed a desire to \u201cremove Wittich\u201d and people like him from political office.<\/p>\n<p><div class=\"well\"><div class=\"dfad dfad_pos_1 dfad_first\" id=\"_ad_652\"><a target=\"_blank\" href=\"https:\/\/goo.gl\/mjhWkW\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/201703_capeair_variable.jpg\" alt=\"CapreAir_Variable\" width=\"510\" height=\"180\" class=\"alignnone size-full wp-image-18069\" \/><\/a><\/div><\/div>On the stand to dispute Steab\u2019s claims, Motl said he did not delete any of Steab\u2019s emails and denied ever making statements about Wittich to Steab. Motl said Steab was \u201cthe last person he would have said\u201d that to.<\/p>\n<p>Asked by the state\u2019s attorney, Gene Jarussi, why that was, Motl responded, \u201cBecause I didn\u2019t trust her.\u201d<\/p>\n<p>A witness from the state\u2019s Information and Technology Services Division testified that the only person who could have deleted the Steab email archive, which was later recovered, was Steab, or someone with her log-in credentials.<\/p>\n<p>Mary Baker, a current COPP employee, testified that she did not delete Steab\u2019s emails. Baker testified that Steab was unhappy with working conditions at the COPP office after Motl came on board in June 2013. Baker said Steab and Motl had a \u201cpersonality conflict.\u201d<\/p>\n<div id=\"attachment_10881\"  class=\"wp-caption module image alignleft\" style=\"max-width: 140px;\"><img loading=\"lazy\" decoding=\"async\" class=\"addboard wp-image-10881 size-full\" src=\"http:\/\/lastbestnews.com\/site\/wp-content\/uploads\/J.-Motl.jpeg\" alt=\"Motl\" width=\"140\" height=\"192\" \/><\/a><p class=\"wp-caption-text\">Jonathan Motl<\/p><\/div>\n<p>Wittich\u2019s attorney, Quentin Rhoades, eventually withdrew a motion asking the court to throw out the case based on \u201cspoliation\u201d of the Steab email archive, and instead asked the court to force Motl to produce the emails.<\/p>\n<p>In a separate motion, Rhoades asked the judge to dismiss the case for lack of jurisdiction. Rhoades argued state law does not allow Motl to independently investigate candidates, such as Wittich, without a formal campaign finance complaint.
